These terms govern your use of foni.ae and any quotation, order or supply agreement between you and us. Please read them before placing an order.
About us
foni.ae is operated by a trading company registered in Dubai, United Arab Emirates. In these terms, “we”, “us” and “foni.ae” mean that company.
Using this website
The content on foni.ae is provided for general information. Product descriptions, categories and availability may change without notice. Nothing on this website is a binding offer to sell.
You may not use this website in any way that is unlawful, or that damages or interferes with its operation.
Quotations
- A quotation is an invitation to order, not a binding contract, until we confirm your order in writing.
- Unless stated otherwise, quotations are valid for 30 days from the date of issue.
- Prices are quoted in UAE Dirhams (AED) unless another currency is stated.
- Quoted prices exclude VAT, freight, insurance, duty and destination charges unless the quotation says otherwise.
Orders
A contract is formed when we issue a written order confirmation or proforma invoice and you accept it. We may decline any order at our discretion, including where stock is unavailable or where supply would breach applicable law or export controls.
Minimum order quantities apply to wholesale lines and are stated per product line.
Payment
- Payment terms are set out in the order confirmation. Unless agreed otherwise, wholesale orders require payment before dispatch.
- Title to goods passes to you only on full payment. Risk passes on delivery in accordance with the agreed Incoterm.
- Bank charges, currency conversion costs and remittance fees are your responsibility.
Delivery and shipping
Delivery timeframes are estimates given in good faith and are not guaranteed. We are not liable for delays caused by carriers, customs authorities, port congestion, or other events outside our reasonable control.
Where we arrange freight, we do so as your agent. The applicable Incoterm is stated in the order confirmation and determines when risk and cost transfer to you.
Import duties and compliance
For international shipments, you are the importer of record unless expressly agreed otherwise. You are responsible for import duties, taxes, licences and ensuring the goods may lawfully be imported into the destination country.
You agree not to re-export goods in breach of any applicable sanctions or export control laws.
Product information and warranties
Where goods carry a manufacturer warranty, that warranty applies on its own terms and we will pass it through to you. Beyond that, and to the extent permitted by UAE law, we give no additional warranty as to fitness for a particular purpose.
Product images and descriptions are indicative. Specifications may vary between production batches.
Liability
Nothing in these terms excludes liability that cannot be excluded under UAE law. Subject to that, our total liability in respect of any order is limited to the invoice value of that order, and we are not liable for indirect or consequential loss, including loss of profit or business interruption.
Intellectual property
The foni.ae name, logo and the content of this website are our property or used under licence. You may not reproduce them without written permission.
Marketplace purchases
Purchases made on Amazon.ae or Noon are governed by those platforms’ terms and their return and dispute processes, in addition to any manufacturer warranty.
Governing law
These terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai. The courts of Dubai have exclusive jurisdiction over any dispute.
